4. USE OF COOKIES
Cookies are pieces of information that a Web site transfers to an individual’s hard drive for record-keeping purposes. Cookies can make the Web more useful by storing information about your preferences on a particular site. We never save passwords or credit card information in cookies. The use of cookies is an industry standard, and many major Web sites use them to provide useful features for their customers.
Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or indicate when a cookie is being sent. However, note that some parts of the Diagnostic Center of Medicine’s service will not function properly or may be considerably slower if you refuse cookies. For example, without cookies, you will not be able to set personalized news preferences or you may have difficulty completing shopping transactions, entering contests, or playing games.
You may occasionally get cookies from our advertisers. Diagnostic Center of Medicine does not control these cookies. The use of advertising cookies sent by third-party servers is standard in the Internet industry.
5. USE OF TRAFFIC DATA
Each time a visitor comes to a Diagnostic Center of Medicine web site, we collect some information to improve the overall quality of the online experience. At Diagnostic Center of Medicine content sites, we collect the visitor’s domain name (e.g., whether the user is logged on from ibm.com or yale.edu), referral data (e.g., we record the address of the last URL a user visited prior to clicking through to a Diagnostic Center of Medicine Web site), and browser and platform type (e.g., a Netscape browser on a Macintosh platform). The Diagnostic Center of Medicine web sites collect visitor information for purposes of product monitoring, product improvement, and targeted advertising. We also count, track, and aggregate the visitor’s activity into our analysis of general traffic flows at our sites (e.g. tracking where traffic comes from, how traffic flows within the Diagnostic Center of Medicine properties, etc.). To these ends, we may merge information about you into group data, which may then be shared on an aggregated basis with our advertisers; but Diagnostic Center of Medicine will not disclose your individual identity or personal data without your permission. When Diagnostic Center of Medicine does present aggregated information to outside companies, no one will be able to identify you or contact you.
6. USE OF IP ADDRESSES
An IP address is a number that’s automatically assigned to your computer whenever you’re surfing the Web. Web servers, the big computers that “serve up” web pages, automatically identify your computer by its IP address.
Diagnostic Center of Medicine collects IP addresses for the purposes of system administration, to report aggregate information to our advertisers, and to audit the use of our site. When guests request pages from Diagnostic Center of Medicine web sites, our servers log the guests’ IP addresses. We do not normally link IP addresses to anything personally identifiable, which means that a user’s session will be logged, but the user remains anonymous to us. We can and will use IP addresses to identify a user when we feel it is necessary to enforce compliance with our rules or terms of service or to protect our service, site, customers or others.
7. USE OF EMAIL DATA
After signing up to receive a Diagnostic Center of Medicine newsletter by email, users will start receiving a Diagnostic Center of Medicine content newsletter delivered on a daily, weekly, or monthly basis, as well as occasional product-related announcements. On Diagnostic Center of Medicine Web sites that offer newsletters, we collect subscribers’ email addresses in order to distribute those newsletters and product-related announcements. In addition, Diagnostic Center of Medicine has entered into agreements with a number of other companies to distribute Diagnostic Center of Medicine newsletter content to users on their systems. These Newsletter Partners might include web-based email, Internet browser, and email software companies. Diagnostic Center of Medicine newsletters are also offered in a number of Newsletter Partner sites, all of which require a user’s email address for distribution. In the case of those email addresses collected by our Newsletter Partners to conduct Diagnostic Center of Medicine newsletter programs, email addresses are either forwarded to us for maintenance by Diagnostic Center of Medicine, or are kept and maintained exclusively by our Newsletter Partners under privacy conditions acceptable to Diagnostic Center of Medicine. If you are concerned about the privacy policies of a Newsletter Partner site, please contact the webmaster of that site. Users can choose to unsubscribe from Diagnostic Center of Medicine newsletters or product-related announcements at any time by following the unsubscribe instructions found in each email.
8. CONTESTS AND SWEEPSTAKES
Diagnostic Center of Medicine offers contests and sweepstakes in which we request certain personal information. At a minimum, the required information includes name and email address; in some cases, the user must answer mandatory survey questions about a range of other personal data. The information gathered in the entry form is used to verify the entrant’s identity, to send the entrant an email notification that their entry has been received, and to contact winners and/or prize recipients. There are two situations in which Diagnostic Center of Medicine will divulge this information to a third party provided the user gives express consent: (1) A user may expressly choose to receive additional information from the contest sponsor, in which case the user’s personally identifiable information is divulged to the advertiser. (2) Some of the contests may be hosted on the Diagnostic Center of Medicine site but administered by the sponsor; in such cases, the information a user provides is passed on to the third party as long as that user gives express consent. Because the rules and terms of each contest can vary, all information about each contest is clearly posted during the event. All contests and sweepstakes are conducted in full accordance with United States federal and state laws.
9. SURVEYS
Occasionally Diagnostic Center of Medicine conducts user surveys to better target our content to our audience. We sometimes share the aggregated demographic information in these surveys with our advertisers and partners. We never share any of this information about specific individuals with any third party.
10. LIMITATION OF LIABILITY
IN NO EVENT SHALL SITEBOX.NET, INC., OR THIRD PARTY PROVIDERS OR DISTRIBUTORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH (I) ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THIS SERVICE OR CONTENT FOUND HEREIN OR IN CONNECTION WITH THE SERVICE, (II) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO THE USE OF OR INABILITY TO USE ANY COMPONENT OF THIS SERVICE OR SITE FOR RESERVATIONS OR TICKETING), OR (III) THE PERFORMANCE OR NON PERFORMANCE BY Diagnostic Center of Medicine OR THIRD PARTY PROVIDERS OR DISTRIBUTORS, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY OTHER PARTY. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL AND CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
11. LINKS TO OTHER SITES
Users should be aware that when you are on Diagnostic Center of Medicine, you could be directed to other sites that are beyond our control. There are links to other sites from Diagnostic Center of Medicine’s pages that take you outside our service. For example, if you “click” on a banner advertisement or an Diagnostic Center of Medicine search result, the “click” takes you off the Diagnostic Center of Medicine site. This includes links from advertisers, Center sponsors and partners that may use Diagnostic Center of Medicine’s logo as part of a co-branding agreement. These other sites may send their own cookies to users, collect data or solicit personal information.
Diagnostic Center of Medicine’s policy does not extend to anything that is inherent in the operation of the Internet, and therefore beyond Diagnostic Center of Medicine’s control, and is not to be applied in any manner contrary to applicable law or governmental regulation.
